DMCA Copyright Policy – Street Ninja Tees

1. Copyright Ownership and Fair Use

When an individual creates an original work that is fixed in a tangible medium, that individual automatically owns the copyright to that work. Copyright ownership grants exclusive rights to use, reproduce, and distribute the work. Eligible works include, but are not limited to, visual artwork, music, written content, software, and video.

Some use of copyrighted materials may be permissible under the U.S. “fair use” doctrine. This includes uses for purposes such as parody, satire, commentary, criticism, or education.

Street Ninja Tees collaborates with independent artists who certify that their designs are original, transformative, and do not infringe on the rights of others. Designs may incorporate parody, satire, or social commentary, which are protected under fair use. Street Ninja Tees is not affiliated with any trademark or copyright holder unless expressly stated and always seeks to respect the intellectual property rights of others.

It is our policy to respond to valid notices of alleged infringement in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. Upon receipt of a properly formatted complaint, we may remove or disable access to the infringing design. We will notify the submitting artist and allow them to respond with a valid DMCA counter-notification under Section 512(g).

2. Submitting a DMCA Takedown Notice

If you believe your copyrighted work has been used on our site without authorization, please include the following:

Identification of the allegedly infringing design and its URL on our site.

A description of the copyrighted work.

A statement explaining why you believe the use is infringing.

Your full legal name, mailing address, email, and phone number.

Statements:

“I have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.”

“This notification is accurate.”

“UNDER PENALTY OF PERJURY, I am the copyright owner or authorized to act on behalf of the owner.”

“I acknowledge that under Section 512(f) of the DMCA, any person who knowingly misrepresents material may be liable for damages.”

3. DMCA Counter-Notification by Artists

If you believe your design was removed in error, you may submit a counter-notification that includes:

A description of the removed design and its URL prior to removal.

A statement explaining why you believe the removal was a mistake.

Your full legal name, contact info, and signature.

Required statements:

“UNDER PENALTY OF PERJURY, I have a good faith belief that the material was removed due to mistake or misidentification.”

“I consent to the jurisdiction of the Federal District Court in my district.”

“I will accept service of process from the complainant.”

4. Repeat Infringement and Policy Enforcement

Street Ninja Tees enforces a three-strike policy for repeat offenders. Any artist who repeatedly infringes or misrepresents others’ work will have their account suspended or permanently banned.
